Welcome to BAJOPHONE (hereinafter, "the Store", "the Website" or "the Seller"). These Terms and Conditions regulate the access, navigation and use of the website, as well as the sale of products offered through it.

By accessing the website and making a purchase, the user (hereinafter, "the Customer" or "the User") unreservedly, expressly and unequivocally accepts these Terms and Conditions. If you do not agree with any part of these terms, please refrain from using our website and making any purchases.

1. EXCLUSIVELY DIGITAL NATURE OF PRODUCTS (ESSENTIAL CLAUSE)

1.1. Exclusivity of Intangible Goods: The Customer acknowledges, understands and expressly and bindingly accepts that BAJOPHONE is EXCLUSIVELY dedicated to the sale of 100% digital products and content (including, but not limited to: downloadable files, images, graphic resources, software, documents, and access to digital projects related to technology).

1.2. Absence of Physical Products: Under no circumstances, or under any interpretation, does BAJOPHONE sell, market, distribute, dispatch or deliver physical or tangible products.

1.3. Explicit recognition of the trade name: The Customer acknowledges that the trade name "BAJOPHONE" is merely a word mark for the commercialization of intangible goods oriented towards technology. By making a purchase on this Website, the Customer expressly accepts that they are NOT purchasing a physical electronic device (such as a mobile phone, smartphone, tablet, hardware, accessories or other physical electronic devices). Any claim based on the expectation of receiving a physical or tangible good will be automatically dismissed, and the Seller reserves the right to provide this clause as proof of the Customer's informed acceptance to payment platforms or banking entities.

2. 100% DIGITAL PURCHASE AND DELIVERY PROCESS

2.1. Confirmation and Immediate Delivery: Given the intangible nature of the products, "delivery" is carried out strictly digitally and automatically. Once the system confirms full payment for the order, the Customer will receive immediate access to the purchased digital files, either through a direct download page on the Website or via a link sent to the email address provided during the purchase process (Checkout).

2.2. Responsibility for provided data: It is the Customer's sole and absolute responsibility to provide a valid, correct and accessible email address during the purchase. BAJOPHONE is not responsible for the non-receipt of the digital product if the Customer has entered an erroneous, false or inactive email address, or if the Customer's spam filters block communication.

2.3. Shipping costs: As there is no physical delivery, all BAJOPHONE products are exempt from shipping, logistics or customs costs.

3. PRICES AND PAYMENT METHODS

3.1. Prices: All prices indicated on the Website are shown in [Indicate Currency, e.g., United States Dollars (USD) / Euros (EUR)] and include applicable taxes corresponding to digital sales, unless otherwise indicated. The Seller reserves the right to modify prices at any time, although products will be invoiced based on the rates in force at the time of order confirmation.

3.2. Payment methods: Payment is due immediately upon placing the order. We accept payments through secure gateways (such as credit/debit cards, PayPal, etc., managed by Shopify Payments or other providers). BAJOPHONE does not directly store bank details or financial information of the Customer.

4. REFUND POLICY AND EXCEPTION TO THE RIGHT OF WITHDRAWAL

4.1. Loss of the right of withdrawal: In accordance with the applicable consumer protection legislation (including European regulations and current legislation in Spain and Latin American countries) applicable to the provision of digital content not supplied on a tangible medium, the Customer expressly accepts that the right of withdrawal (or return) is irremediably lost at the moment the download, dispatch or access to the digital file begins.

4.2. Absence of Refunds: Due to the immediate and irreversible nature of digital products (which can be copied, saved and duplicated instantly), all sales are final. BAJOPHONE does not offer exchanges, returns or refunds under any circumstances once the order has been processed and the download or access link has been generated and sent.

4.3. Exceptions: An exceptional review will only be considered if the digital file presents a verifiable technical defect that absolutely prevents its opening or use, provided that the Customer notifies us within a maximum of 48 hours after purchase, and our support team cannot provide a functional replacement file.

5. INTELLECTUAL PROPERTY AND LICENSE OF USE

5.1. License of Use: The purchase of a digital product from BAJOPHONE does not transfer its intellectual property. By making the purchase, the Customer only acquires a personal, individual, non-exclusive, non-transferable and non-sublicensable license of use.

5.2. Prohibitions: Any form of mass reproduction, distribution, resale, sublicense, rental, modification, translation or unauthorized commercial use of the acquired digital products (files, texts, images, code, etc.) is strictly prohibited. Any unauthorized use or piracy will be legally prosecuted and will result in the immediate cancellation of any access or service, without right to refund, in addition to any corresponding civil or criminal actions.

6. EXEMPTION AND LIMITATION OF LIABILITY

6.1. BAJOPHONE will not be liable for direct, indirect, incidental or consequential damages that may arise from the use or inability to use the purchased digital products.

6.2. The Customer is responsible for having the basic software, hardware and technical knowledge necessary to download, decompress (e.g., .zip files) and open or use the digital files purchased from our Store. BAJOPHONE does not offer technical support for the configuration or teaching in the use of the files once delivered, unless expressly indicated in the product description.

7. MODIFICATION OF THE TERMS AND CONDITIONS

BAJOPHONE reserves the right to update, modify or replace any part of these Terms and Conditions by posting updates and/or changes on our website. It is the Customer's responsibility to review this page periodically for changes. Continued use of or access to the website after the posting of any changes constitutes acceptance of such modifications.

8. APPLICABLE LAW AND JURISDICTION
